Membership |

Registration |

All Malaysians above the age of 18 who currently reside in
Malaysia may become a member of Mybids. Membership is free of charge. Applicants
warrant that the information they provide in the registration form is true
and correct. |
| 1.2 |
Transfer Limit |
| |
A maximum transfer limit of RM5000 for Credit Card & Bank Transfers through iPay88 is applied. |
| 1.3 |
Account / Credit Balances |
| |
Any balance remaining in a Member's Account is non-refundable.
Any credit in a Member's Account that has not been logged into at least
once in a six month period will expire. |
| 1.4 |
Cancellation of Membership by Member |
| |
Members who wish to cancel their Mybids Membership are required
to send an email to Mybids requesting for the cancellation. This is provided
they do not have any bids in place in an active auction. |
| 1.5 |
Cancellation or Suspension of Membership by Mybids |
| |
Mybids may cancel or suspend a Member's Account due to a breach
in our Terms and Conditions by the member or at the sole discretion of Mybids. |

Promotions |
| |
At any time Mybids may implement promotions which may include
discounted bids or free bids for members. These promotions may or may not
run for a specified time and may be terminated or extended without notice
to Mybids members. Discounted bids and free bids are for use only in Mybids
and may not be redeemed for cash or any other means. |

Mybids Auction & E-Commerce |
| 2.1 |
Auction Declaration |
| |
For each specific Mybids Auction, Mybids will determine the
following: |
| |
|
1. The product or service being sold.
2. The maximum bid amount.
3. The maximum number of bids that will be accepted on that auction.
4. The maximum number of bids per day or per auction per bidder that will
be accepted on that auction.
5. The start and end date of the auction.
6. The bidding fee payable on each bid.
7. The bid increment. |

Bid Acceptance |
| |
Mybids will only accept a bid on an active auction if: |
| |
|
1. The bidder is a registered Mybids member.
2. The bidder has not reached the member daily bid limit / member bid
limit for the auction.
3. The bid amount is a valid bid amount.
4. Payment of the bidding fee has been received by Mybids.
5. The bidder has not breached any Terms and Conditions of this agreement. |

Bid Process |

1. A member may not cancel, withdraw or alter a bid after
it has been submitted by the member.
2. Mybids will not disclose the number of bids received or the value of
the bids submitted during the course of an auction. A "Closing Soon"
sign is displayed on the auction listing when the auction is about to end.

End of Auction |

Auction in Mybids closes and the successful bidder will be
announced by Mybids when: |
| |
|
1. The Maximum Number of Bids for the auction have been reached; or
2. The End Date of the auction has been reached. * |
| | * MyBids reserves the right to extend the auction end date for 1 month if 70% of the maximum number of bids has not been received 24 hours before the closing date. In this event, all members who have placed 20 bids and above (24 hours before the initial closing date) will be credited 3 free bids to compensate for the extension of the auction end date. All members who participated in the auction will be notified by email upon any extension of the auction end date. |

Auction Winner Declaration |

Member’s username will be published in the “Results”
page. |
| 2.6 |
Auction Results |
| |
Auction results will be displayed on the website after the
close of an auction and a list of all the bids received will be displayed
for all members to view. |

Product Pricing |
| |
Product pricing for "Buy Now" items may vary. MyBids
reserves the rights to ammend "Buy Now" items at any time. Product
pricing of all sales transactions that has been completed are non-negotiable. |

Product or Service Delivery |
| 3.1 |
Notification to Auction Winner |
| |
A notification email will be sent to the successful bidder's
registered email address within 24 hours of the close of an auction. The
successful bidder is required to pay Mybids the successful bid amount (highest
unique bid amount) to Mybids. Mybids will then deliver the goods within
10 working days upon receiving the full successful bid amount following
the close of the auction. |

Delivery Verification |

It is a requirement for auction winners to show their Malaysian
Identity Card (IC) before receiving the item from the courier service delivery
person. Mybids has the right not to hand over the item won and refund the
successful bidder the highest unique amount should he or she fails to produce
his or her IC for verification purposes. It is therefore necessary for members
to ensure that all member details provided in the membership registration
form are true and correct. |

Delivery / Courier Charges |

1. Unless otherwise stated goods delivered within Malaysia
are free of charge.
2. Mybids may not be the supplier of the products and or services. Delivery
of the product and or service may be made directly from the suppliers or
distributors. |

Installation of Products |

Unless otherwise stated, installation services for products
won or bought are not included. |

| 4.0 |
Buy Back Guarantee |
| 4.1 |
Mybids warrants that the description of the goods and services
offered for bidding or purchasing on this website accurately reflect the
condition, state and nature of the good or service. |
| 4.2 |
In the event that the good or service supplied to the bidder
or buyer does not comply with the description of the good or service auctioned
by Mybids, the bidder or buyer may within 30 days of receipt of item return
the item supplied by Mybids to Mybids. |
| 4.3 |
In the event that the item is returned by the bidder of the
auction to Mybids in the condition which it was supplied to the bidder,
Mybids will only refund the “Successful Bid Amount” to the bidder. |
| 4.4 |
In the event that the item is returned by the buyer to Mybids
in the condition which it was supplied to the buyer, Mybids will refund
the “Full Purchase Amount” to the buyer. |
| 4.5 |
All responsibility and expenses for product returns will be
bared by bidders of auction and buyers of items. Mybids will not be held
liable for any product lost or damaged on the course of delivery returns
to Mybids. |

General |

All information, text, material, graphics and advertisements
on this site are protected by Malaysian and International copyright and
trademarks. |

This site contains hyperlinks and picture links to internet
websites not operated or provided by Mybids. Mybids is not responsible for
information and or representations contained in websites linked to Mybids’
website. You may link to any of such website at your own risk. |

Mybids warrants that the products auctioned through this site
will correspond to the description given of the products. |
| 5.4 |
Mybids does not guarantee a continuous uninterrupted or a
secure access to Mybids site. |

In no event shall Mybids be held liable for lost profits
or any special, incidental or consequential damages arising out of or
in connection with Mybids’ website, Mybids’ services or this
agreement.

Mybids is not liable for your actions on Mybids site. You
agree and warrant to act in a lawful manner and in accordance with the laws
that apply to you. |

No agency, partnership, joint venture, employee-employer or
franchiser-franchisee relationships exist between you and Mybids. |

Breach of Agreement |
| 6.1 |
Mybids relies on the information provided by you to register
on this site. You breach this agreement if you: |
| |

1. Have engaged in fraudulent activity in connection with Mybids’
website.
2. Provided any information that may be false, inaccurate or misleading
or that contains any profanity or obscenity.
3. Have contravened any law, statute, ordinance or regulation.
4. Introduced viruses, Trojan Horses, time bombs, easter eggs, worms or
cancelbots that may detrimentally interfere with, modify, surreptitiously
intercept, damage, delete, access without authority or expropriate any system,
data or personal information on the Mybids website.
5. Create a liability for us or cause us to lose the services of Mybids’
ISP’s or other suppliers. |
| 6.2 |
You breach this agreement if you use any device, software
or routine to bypass interfere or attempt to interfere with the proper working
of Mybids’ website or any transaction being conducted through Mybids’
website. |
| 6.3 |
You breach this agreement if you take any action that imposes
an unreasonable or disproportionately large load on Mybids' infrastructure. |
| 6.4 |
You breach this agreement if you copy, reproduce, alter, modify,
create derivative works, or publicly display any content from Mybids’
site without the prior written permission of Mybids or an authorised third
party. |
| 6.5 |
You breach this agreement if you do not comply with all
applicable domestic and international laws, statutes, ordinances and regulations
regarding your use of Mybids’ service and your bidding on and purchase
of items. You must ensure that you comply with all applicable laws. Mybids
does not accept any responsibility for confirming that your activities
are lawful. |

| 7.0 |
Remedies |
| 7.1 |
If you do not perform or comply with any obligation under
this agreement, Mybids is entitled to remedy your breach and to recover
damages for loss caused by your breach of the agreement by: |

1. Issuing a warning to remedy your breach.
2. Suspending (either temporarily or indefinitely) your registration.
3. Refusing to provide Mybids' services to you.
4. Terminating your account; and
5. Suing you for loss and damage. |
| 7.2 |
You agree to indemnify Mybids and as applicable Mybids’
officers, directors, agents and employees from any claims, demands, proceedings,
losses and damages (actual, special and consequential) of every kind and
nature, known and unknown, including reasonable solicitor's fees made to
any third party due to or arising out of your breach of this agreement. |

Privacy |
| 8.1 |
The information that you provide to Mybids in the registration
or bidding process is subject to Mybids’ Privacy Policy. Mybids’
Privacy Policy is incorporated into this agreement. By registering as a
member you acknowledge that you have read and accepted the terms and conditions
of Mybids’ Privacy Policy. |
| 8.2 |
Mybids reserves the right to publish the name of auction winners
on its site and other promotional material. |
